These Terms govern your use of this website (“Website”) and your participation in Larian Studios ARG. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using the Website.

Eligibility

a. By accessing the Website, you affirm that you have the legal capacity to enter into these Terms or have obtained the necessary consent from your parent or legal guardian.

License and Restrictions

a. The ARG and all related content, including text, graphics, audio, images, and software, are owned by Larian Studios and its licensors and are protected by intellectual property laws.

b. You are granted a limited, non-exclusive, non-transferable license to use the Website solely for the purpose of participating in the ARG.

c. You agree not to:

i. Modify, distribute, reproduce, display, publicly perform, or create derivative works of the Website or the ARG, except as allowed in Larian Studios’ Fan Content Policy (https://larian.com/fan-content-policy);

ii. Use the Website for any commercial purpose or for any illegal or unauthorized activity;

iii. Engage in any form of cheating, hacking, or exploiting of the Website or the ARG;

iv. Disrupt or interfere with the functioning of the Website or the ARG or compromise the security or integrity of the Website or the ARG;

v. Harass, threaten, or otherwise violate the rights of other participants or users of the Website.

User Content

a. By participating in the ARG, you may have the opportunity to create some user-generated content, including text, images, and audio.

b. You retain ownership of your user-generated content you submit, but you grant Larian Studios a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, and display such content in connection with the ARG.

c. You warrant that any of your user-generated content does not infringe upon the rights of any third party, including intellectual property rights, and does not violate any applicable laws or regulations.

Privacy

a. The collection and use of personal information are subject to our Privacy Policy https://larian.com/privacy.

b. We do not process personal in connection with the ARG other than in relation to your participation in the ARG by voting. The collection, storage, and processing of personal information in relation to this process is further described as you register for voting.

Termination

a. We reserve the right to suspend or terminate your access to the Website and participation in the ARG, at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

b. Upon termination, all licenses and rights granted to you under these Terms will cease, and you must cease all use of the Website.

Limitation of Liability

a. The Website and ARG are provided “as is”. Larian Studios disclaims all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement.

b. In no event shall Larian Studios be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the Website or participation in the ARG.

a. These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of laws principles.
